Photo Release Agreement

This Photo Release Agreement ("Agreement") is entered into between Rakowski PhotoVisions (the "Photographer") and the individual accepting the terms of this Agreement (the "Model").

By accepting this Agreement, the Model confirms that they have read, understood, and voluntarily agree to the following terms.

1. Grant of Permission

The Model grants the Photographer the irrevocable, worldwide, non-exclusive right to photograph, record and use the Model's likeness, appearance, image, voice (if applicable), name and any photographs or audiovisual material created during the photo session.

This permission is granted without geographical limitation and remains valid indefinitely unless otherwise required by applicable law.

2. Copyright

The Model acknowledges that all photographs and related works remain the exclusive intellectual property of the Photographer.

Nothing in this Agreement transfers copyright ownership to the Model.

3. Permitted Uses

The Photographer may use the photographs for any lawful purpose, including but not limited to:

  • professional portfolio

  • personal website

  • social media

  • exhibitions

  • photography competitions

  • photography awards

  • printed materials

  • advertising

  • promotional campaigns

  • editorial publications

  • books

  • blogs

  • online galleries

  • educational presentations

  • licensing to third parties

  • commercial projects

4. Editorial and Magazine Submission

The Model expressly authorizes the Photographer to submit the photographs to magazines, publishers and editorial platforms including, but not limited to:

  • Kavyar

  • editorial magazines

  • fashion magazines

  • photography magazines

  • online publications

  • galleries

  • exhibitions

  • photography competitions

The Model understands that publication decisions are made solely by the publishers or organizers and are outside the Photographer's control.

5. Image Editing

The Model authorizes the Photographer to edit the photographs, including but not limited to:

  • color correction

  • retouching

  • cropping

  • artistic editing

  • background replacement

  • compositing

  • black & white conversion

  • creative effects

provided that such editing does not intentionally portray the Model in a defamatory or misleading manner.

6. AI-Assisted Post-Production

The Model acknowledges that modern digital editing tools, including artificial intelligence ("AI"), may be used solely as part of the creative post-production process.

Such tools may be used for tasks including:

  • skin retouching

  • background cleanup

  • object removal

  • color grading

  • image enhancement

  • creative visual effects

The Photographer will not intentionally use AI to create false or misleading representations of the Model's identity without separate written consent.

7. Compensation

The Model confirms that any compensation agreed upon for the photo session constitutes full consideration for the rights granted under this Agreement.

No additional royalties or future payments shall be owed for the authorized use of the photographs.

8. No Obligation to Publish

The Photographer is under no obligation to publish, distribute or otherwise use any photographs created during the session.

9. Irrevocability

The permissions granted under this Agreement are intended to be irrevocable once the photographs have been published or licensed.

The Model understands that, after publication, complete removal of photographs from printed materials, magazines, websites, archives, search engines or third-party platforms may not be possible.

Nothing in this clause limits any non-waivable rights the Model may have under applicable law.

10. Respectful Use

The Photographer agrees not to knowingly use the photographs in a manner that is defamatory, unlawful, or intended to damage the Model's reputation.

11. Governing Law

This Agreement shall be governed by the laws applicable in the country where the Photographer is established, unless mandatory provisions of applicable law require otherwise.

12. Entire Agreement

This Agreement constitutes the entire understanding between the Photographer and the Model concerning the use of the photographs and supersedes any prior oral or written agreements relating to the same subject matter.

Electronic Acceptance

By selecting the acceptance checkbox on this website, the Model confirms that:

  • they have read this Agreement in full;

  • they understand its contents;

  • they are at least 18 years of age or have legal authority to enter into this Agreement;

  • they voluntarily agree to be legally bound by its terms;

  • their electronic acceptance shall have the same legal effect as a handwritten signature, to the extent permitted by applicable law.
