These Terms & Conditions govern all photography services provided by Rakowski PhotoVisions ("the Photographer"). By booking or participating in a photography session, the Client and/or Model acknowledges that they have read, understood, and agree to these Terms & Conditions.

1. Booking

A photography session is considered booked once the Photographer and the Client/Model have agreed upon the session date, time, location, and applicable terms.

The Photographer reserves the right to refuse or decline any booking at their discretion.

2. Session Types

Photography sessions may include, but are not limited to:

  • Paid Photography Sessions

  • TFP (Time For Photos) Collaborations

  • Portrait Photography

  • Editorial Photography

  • Fashion Photography

  • Creative Projects

Specific arrangements shall be agreed individually before each session.

3. Booking Deposit (Paid Sessions)

For all paid photography sessions, a 20% booking deposit is required to secure the agreed session date and time.

A booking is considered confirmed only after the deposit has been received.

The booking deposit forms part of the total session fee and will be deducted from the final balance.

The deposit will be fully refunded if the Client cancels the session at least 48 hours before the scheduled start time.

If the Client cancels the session less than 48 hours before the scheduled start time, the booking deposit is non-refundable, unless otherwise agreed by the Photographer.

If the Photographer cancels the session, the Client may choose between:

  • a full refund of the booking deposit, or

  • transferring the deposit to a new mutually agreed session date.

4. Punctuality

The Client/Model agrees to arrive on time.

Late arrival may reduce the available shooting time.

If the delay makes it impossible to complete the session as planned, the Photographer reserves the right to shorten or cancel the session.

5. Weather Conditions

Outdoor sessions may be rescheduled if weather conditions significantly affect safety or the planned artistic outcome.

The Photographer and Client/Model will cooperate in selecting a new session date.

6. Creative Direction

The Client/Model acknowledges that the Photographer maintains full artistic control over the session, including but not limited to:

  • posing

  • lighting

  • composition

  • camera settings

  • editing style

  • colour grading

  • retouching

  • image selection

  • final presentation

Creative decisions remain solely at the Photographer's discretion.

7. Portfolio Style

Before booking, the Client/Model is encouraged to review the Photographer's portfolio.

By booking the session, the Client/Model acknowledges that they understand and accept the Photographer's artistic style.

Differences in artistic taste shall not constitute grounds for refunds or rejection of delivered photographs.

8. Image Selection

The Photographer alone determines which photographs meet the artistic and technical standards for delivery.

RAW files and unedited images are not provided unless expressly agreed in writing.

9. Image Delivery

Unless otherwise agreed:

  • photographs will be delivered digitally;

  • delivery time depends on the complexity of the project and current workload;

  • the Photographer will make reasonable efforts to deliver the images within the agreed timeframe.

10. Additional Editing

Minor retouching requests may be accommodated where reasonable.

Requests exceeding the original agreement may be subject to additional charges.

11. Model Responsibilities

The Model agrees to:

  • arrive prepared for the session;

  • inform the Photographer of any relevant health or physical limitations that may affect the session;

  • bring any agreed wardrobe, accessories or props;

  • behave respectfully throughout the session.

12. Photographer Responsibilities

The Photographer agrees to:

  • conduct the session professionally;

  • provide the agreed photographic services;

  • maintain a respectful and professional working environment.

13. Safety

Either party may terminate the session immediately if continuing would create an unsafe or inappropriate situation.

14. TFP Collaborations

For TFP (Time For Photos) collaborations:

  • no financial compensation is paid unless agreed otherwise;

  • both parties contribute their time and skills;

  • the number of edited photographs and delivery timeframe will be agreed before the session.

15. Paid Sessions

For paid sessions:

  • pricing shall be agreed before the booking is confirmed;

  • any additional services requested after booking may incur additional charges.

16. Force Majeure

Neither party shall be liable for delays or cancellations resulting from circumstances beyond their reasonable control, including but not limited to:

  • severe weather

  • natural disasters

  • illness

  • transportation disruptions

  • government restrictions

  • other unforeseen events.

17. Copyright

Copyright ownership and image usage rights are governed separately by the Photo Release Agreement, which forms an integral part of these Terms & Conditions.

18. Governing Law

These Terms & Conditions shall be governed by the laws applicable in the country where the Photographer is established, unless mandatory provisions of applicable law require otherwise.

19. Acceptance

By submitting a booking request, participating in a photography session, or accepting these Terms & Conditions electronically, the Client and/or Model confirms that:

  • they have read these Terms & Conditions;

  • they understand them;

  • they voluntarily agree to be legally bound by them.

Electronic acceptance shall have the same legal effect as a handwritten signature to the extent permitted by applicable law.
